Yeah it's such bs. What the hell are they going to do when my Dad passes away? He's sixty, no spring chicken. They can't base her income on mine.

Well, if they overpaid and your mom didn't notice... she should've noticed, that's how it usually works.

They thrive on such mistakes of theirs.
I'm not saying it's her fault, because it's theirs. But if she didn't notice and spent what wasn't hers in the first place, there is no way they will let it slide. I know they wouldn't let it go in Poland. Especially $5k is a lot of money. I'd ask them to split the debt into installments. Unless there is some law in the US that allows her to avoid paying it back.

@memoriam: Not really. See my mom always gets a letter on how much she gets that they are paying her. The most was like $700 a month. Then it went down over the months if my dad gets more hours or more money. If he gets more money then they send a letter saying she gets such and such less a month. They add up my dad's pay checks to figure out what to pay my mom.
Example:
Month 1: $700
Month 2: $700
Month 3: Dad's pay goes up so they add up his pay checks that he sends them and they decide she gets less. Say $600. The amount they pay her goes up or down depending on how much my dad makes a month. They request his checks and they add it all up. So I don't see how she got over paid.
My dad makes about $12.50 or less for two weeks now. So now her amount is $40. Before that he made about $10.00 and she got more because he was making less. If he makes less, she gets more. But if he makes more, she gets less. That's how they do it.
She has never gone over $800 if near that. So them adding up the checks and sending the letters to her is all on them not us. We can't tell we're getting over paid. Now if we had gotten $800 or more than we would have called and asked if there was a mistake or what. Because for almost a year they gave us around $700 and never once said anything. They're doing all the adding up of checks and sending my mom the papers saying how much she gets.
She's disabled and can't work. Her back is deteriorating, and because she didn't work much when she was younger she doesn't get jack. There was no way we could tell in a span of six years or less that she was getting over paid. It mainly went down, so how could she have gotten over paid?
They sent a letter say we can contend it. Saying in the paper that we can use the clause that if it's their fault then we don't have to pay it.

Wow, what a mess

It's definitely their fault and should be contended.
At the very least they shouldn't be able to take it back from you, just send less until it's "paid off"....not that they're sending much already.

Aw, DC, that sounds like they just made a horrible mess and hope that they can intimidate you into paying for their mistakes. Good luck to your mom for contending it!
