You cannot copy the exact design of an item (which I didn't, apart from the fact that they both have butterfly wings there is nothing similar), there is nothing wrong with adapting an idea and making a rip-off of a popular item.
I can make a magic wand, yet I am not breaking harry potter copyright, I can make a face scar, yet I am not breaking Ruroni Kenshin copyright. It's not about the actually item, but the exact design you cannot just copy.
